Important Information
# ‘yes Time’ – free 20 minute calls to mobiles on the Optus GSM network made between 8pm and midnight. Calls must be made and received within Australia. No charge applies for the first 20 minutes of duration per call, after which the standard call rates of your plan apply. ‘yes’ Time is a promotional offer and available until March 31, 2010 (unless extended) and could be withdrawn at any time. Optus Fair Go policy applies up to 2000 minutes per month. ‘yes’ Time is not available on the $29 Cap.
§ If you connect on a month-to-month basis: If your service is disconnected for any reason or you switch providers within 3 months of activation we will charge you a $50 deferred activation fee to cover our costs of establishing your service. The total minimum cost to you for $29 Cap is $29; $49 Cap is $49; $79 Cap is $79; $99 Cap is $99; $129 Cap is $129; plus the deferred activation fee.
† $1 for 2MB Daily Cap is our default pay-as-you-go rate for Mobile Internet usage. For rating purposes a ‘day’ is defined as the period from 00:00:00 hours to 23:59:59 hours. Data includes both uploads and downloads. Daily Cap pricing is not applicable where you choose to add a Mobile Internet Pack.

If you fail to port your number to us within 21 days of delivery of your handset or your service is disconnected for any reason or you switch providers within the minimum service term, an early termination fee of $40 per month for each remaining month of the minimum service term, plus any outstanding charges and any remaining handset payments (if applicable), is payable immediately. Some of the features of the handset may be limited or not supported on our network. To access 3G services you must be in a 3G or HSDPA coverage area with a 3G/HSDPA compatible handset or device. Standard rates apply once your Cap included value is reached. Offer subject to change and available until September 12, 2010 but only while stocks last.
Terms and Conditions
mycircle Caps are available only to new credit approved personal customers. Minimum monthly spend is $29 ($29 Cap), $49 ($49 Cap), $79 ($79 Cap), $99 ($99 Cap) or $129 ($129 Cap). You will pay the minimum spend amount each month even if you don’t make calls to that value. For a part month, you will only pay part of the minimum monthly spend and you will also receive only part of the Cap included value. Cap included value excludes some services. Unused Cap included value does not roll over into the following month and is not transferable. The standard rates of your plan apply once the Cap included value is exceeded.
Cap included value excludes some services such as operator assisted (including 124YES) and premium number (e.g. 1900) calls, international voice and video calls (including calls to fixed lines or GSM mobiles that then divert/switch or re-route overseas), directory assistance, international MMS, premium and third party SMS, Mobile Internet usage, Instant Messaging, Zoo and third party subscriptions and content.
Unused Cap included value does not roll over into the following month and is not transferable. The standard rates of your plan apply once the Cap included value is reached.

If you connect for 24 months the total minimum cost to you over 24 months is $696 ($29 Cap), $1176 ($49 Cap), $1896 ($79 Cap), $2376 ($99 Cap), or $3096 ($129 Cap) respectively, excluding any additional or Cap excluded service costs or any additional handset repayments (if applicable).
Early Termination Fees
